Are CBD Oils Legal in the United States

Medical marijuana has been legalized in 33 states. The remaining 17 states passed a law allowing CBD oil use. Cannabidiol extract or CBD oil has negligible THC [Tetrahydrocannabinol] level that causes the euphoric, intoxicating effect on the mind and body. Marijuana helps treat seizures or epilepsy, so doctors recommend CBD products because it is non-psychoactive.

Cannabis is used for recreational and medical purposes. Some states like Arizona disapproved of marijuana for adult recreational purposes. States passing specific CBD laws and not legalizing medical marijuana

Several states passed CBD-specific laws but do not allow the use of weeds for medical purposes.

Alabama – Carly’s Law was signed that allows favorable protection against suing people possessing CBD oil they are prescribed to use for their debilitating epileptic condition. However, the prescription to use CBD will exclusively be provided by the University of Alabama at Birmingham [UAB]. Doctors are disallowed to prescribe medical marijuana.

Georgia – According to the law, the THC level must not exceed 5%. The state is also allowed to grow and sell cannabis. Patients eligible for Registry cards for low THC oil must be suffering from the mentioned 16 medical conditions.

Indiana – Law allows CBD 5% and THC less than 0.3% for epilepsy treatment.

Iowa – Iowa legal department has created a 124E code, which describes how a person can possess, dispense, use, administer, transport or deliver medical CBD.

Kansas – The law allows the sale and use of CBD, which has not more than 5% THC for incapacitating medical condition treatment.

Kentucky – The law does not clearly define how patients can obtain CBD but they will need a written order from physicians.

Mississippi – The CBD oil you buy from licensed pharmacies has to be lab-tested.

North Carolina – Extract from the industry-grade hemp plant has to have THC as low as 0.9% and CBD minimum 5%. However, the cultivation and extracting of hemp are illegal. People will need DHHS Caregiver Registration letter to carry hemp oil outside their homes.

There are several other states including Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, Virginia, Wisconsin, and Wyoming. However, make sure to check your state to see if CBD oil is legal or not before you plan to buy it. It is wise to know the legal protocols to avoid penalties.
